The i4i - Microsoft battle is turning out to be a David - Goliath story with i4i winning the second round. i4i claims that the 2007 version of Microsoft Word and Microsoft Office infringes one of its patents. Microsoft is to pull Word and Office off the shelves and pay $290 million as damages.

At one point, Canadian company i4i's legal proceedings against computer colossus Microsoft would have caught nobody's attention. However, with i4i leading 2-0 in the court battle, all eyes are now trained on the two companies.

Proceedings began in May 2007 when i4i claimed that the 2007 version of Microsoft Word (MS Word) and Microsoft Office (MS Office) infringed one of its patents. MS Word and Office violate the patent in the manner in which they allow a user to edit Extensible Markup Language (XML) - a set of rules that encode documents electronically.

In August, the District Court of Texas ruled in i4i's favour. Judge Leonard Davis, entered an injunction against Microsoft which stated that MS Word and Office 2007, unless changed, would have to be pulled off the shelves by January 11, 2010. In addition, Microsoft was to pay $290 million (Rs. 1,390 crore) as damages to i4i.

The order of the Texas District Court was challenged before the Court of Appeals in September. Microsoft temporarily steered clear of the injunction with a stay order from the court pending the result of the appeal. However the court yesterday ruled in favour of the Toronto based company, upholding the orders of the district court.

Before the Court of Appeals, i4i and trial counsels, McKool Smith, turned to boutique IP firmFinnegan, Henderson, Farabow, Garrett & Dunner to handle the appeal. IP Litigation Partner, Donald Dunner, Trial Litigation Partners, Don O. Burley and Erik R. Puknys, and Appellate Patent Litigation Partner, Kara Stoll represented i4i in the appeal.

Microsoft was represented by Weil Gotshal & Manges, Gibson, Dunn & Crutcher LLP, along with Texas based Findlay Craft. Lead Attorney Mathew Powers led the team along with Partner Kevin Kudlac and Special Counsel Amber Rovner of Weil Gotshal. The Gibson team was lead by Partners, Matthew D. McGill and Minodora D. Vancea. The name partner of Findlay, Eric Findlay assisted the Weil Gotshal team.

The litigation also saw Dell and Hewlett Packard (HP) act as Amicus to assist the Court, since they are the largest distributors of the Microsoft Software in through their computers. Fish & Richarson's Partners, Indranil Mukerji and John Thornburgh advised both Dell and HP in filing the Amicus brief. Richard A. Samp and Daniel J. Popeo were the counsels for Washington Legal Foundation, who also acted as Amicus to the Court.

One can expect Microsoft to either appeal to the Supreme Court or come to a settlement with i4i in the near future. For now, Microsoft is aiming to comply with the injunction by changing MS Word and MS Office and minimising possible losses as much as possible. A new version of Microsoft Office, the Office 2010 will be released early next year in any case- a 'safe' version which does not contain the infringing code.

Sand. Made up of 25 percent silicon, is, after oxygen, the second most abundant chemical element that's in the earth's crust. Sand, especially quartz, has high percentages of silicon in the form of silicon dioxide (SiO2) and is the base ingredient for semiconductor manufacturing.

After procuring raw sand and separating the silicon, the excess material is disposed of and the silicon is purified in multiple steps to finally reach semiconductor manufacturing quality which is called electronic grade silicon. The resulting purity is so great that electronic grade silicon may only have one alien atom for every one billion silicon atoms. After the purification process, the silicon enters the melting phase. In this picture you can see how one big crystal is grown from the purified silicon melt. The resulting mono-crystal is called an ingot.

A mono-crystal ingot is produced from electronic grade silicon. One ingot weighs approximately 100 kilograms (or 220 pounds) and has a silicon purity of 99.9999 percent

The ingot is then moved onto the slicing phase where individual silicon discs, called wafers, are sliced thin. Some ingots can stand higher than five feet. Several different diameters of ingots exist depending on the required wafer size. Today, CPUs are commonly made on 300 mm wafers

Once cut, the wafers are polished until they have flawless, mirror-smooth surfaces. Intel doesn't produce its own ingots and wafers, and instead purchases manufacturing-ready wafers from third-party companies. Intel’s advanced 45 nm High-K/Metal Gate process uses wafers with a diameter of 300 mm (or 12-inches). When Intel first began making chips, it printed circuits on 50 mm (2-inches) wafers. These days, Intel uses 300 mm wafers, resulting in decreased costs per chip

The blue liquid, depicted above, is a photo resist finish similar to those used in film for photography. The wafer spins during this step to allow an evenly-distributed coating that's smooth and also very thin

At this stage, the photo-resistant finish is exposed to ultra violet (UV) light. The chemical reaction triggered by the UV light is similar to what happens to film material in a camera the moment you press the shutter button.

Areas of the resist on the wafer that have been exposed to UV light will become soluble. The exposure is done using masks that act like stencils. When used with UV light, masks create the various circuit patterns. The building of a CPU essentially repeats this process over and over until multiple layers are stacked on top of each other.

A lens (middle) reduces the mask's image to a small focal point. The resulting "print" on the wafer is typically four times smaller, linearly, than the mask's pattern

In the picture we have a representation of what a single transistor would appear like if we could see it with the naked eye. A transistor acts as a switch, controlling the flow of electrical current in a computer chip. Intel researchers have developed transistors so small that they claim roughly 30 million of them could fit on the head of a pin

After being exposed to UV light, the exposed blue photo resist areas are completely dissolved by a solvent. This reveals a pattern of photo resist made by the mask. The beginnings of transistors, interconnects, and other electrical contacts begin to grow from this point.

The photo resist layer protects wafer material that should not be etched away. Areas that were exposed will be etched away with chemicals

After the etching, the photo resist is removed and the desired shape becomes visible

More photo resist (blue) is applied and then re-exposed to UV light. Exposed photo resist is then washed off again before the next step, which is called ion doping. This is the step where ion particles are exposed to the wafer, allowing the silicon to change its chemical properties in a way that allows the CPU to control the flow of electricity

Through a process called ion implantation (one form of a process called doping) the exposed areas of the silicon wafer are bombarded with ions. Ions are implanted in the silicon wafer to alter the way silicon?i these areas conduct electricity. Ions are propelled onto the surface of the wafer at very high velocities. An electrical field accelerates the ions to a speed of over 300,000 km/hour (roughly 185,000 mph)

After the ion implantation, the photo resist will be removed and the material that should have been doped (green) now has alien atoms implanted.

This transistor is close to being finished. Three holes have been etched into the insulation layer (magenta color) above the transistor. These three holes will be filled with copper, which will make up the connections to other transistors.

The wafers are put into a copper sulphate solution at this stage. Copper ions are deposited onto the transistor through a process called electroplating. The copper ions travel from the positive terminal (anode) to the negative terminal (cathode) which is represented by the wafer

The copper ions settle as a thin layer on the wafer surface.

The excess material is polished off leaving a very thin layer of copper.

Multiple metal layers are created to interconnects (think wires) in between the various transistors. How these connections have to be “wired” is determined by the architecture and design teams that develop the functionality of the respective processor (for example, Intel’s Core i7 processor). While computer chips look extremely flat, they may actually have over 20 layers to form complex circuitry. If you look at a magnified view of a chip, you will see an intricate network of circuit lines and transistors that look like a futuristic, multi-layered highway system

This fraction of a ready wafer is being put through a first functionality test. In this stage test patterns are fed into every single chip and the response from the chip monitored and compared to "the right answer."

After tests determine that the wafer has a good yield of functioning processor units, the wafer is cut into pieces (called dies).

The dies that responded with the right answer to the test pattern will be put forward for the next step (packaging). Bad dies are discarded. Several years ago, Intel made key chains out of bad CPU dies

This is an individual die, which has been cut out in the previous step (slicing). The die shown here is a die of an Intel Core i7 processor

The substrate, the die, and the heatspreader are put together to form a completed processor. The green substrate builds the electrical and mechanical interface for the processor to interact with the rest of the PC system. The silver heatspreader is a thermal interface where a cooling solution will be applied. This will keep the processor cool during operation

A microprocessor is the most complex manufactured product on earth. In fact, it takes hundreds of steps and only the most important ones have been visualized in this picture story.

During this final test the processors will be tested for their key characteristics (among the tested characteristics are power dissipation and maximum frequency).

Based on the test result of class testing processors with the same capabilities are put into the same transporting trays. This process is called "binning". Binning determines the maximum operating frequency of a processor, and batches are divided and sold according to stable specifications.

The manufactured and tested processors (again Intel Core i7 processor is shown here) either go to system manufacturers in trays or into retail stores in a box. Mystery of Argleton, the 'Google' town that only exists online

Argleton, a 'phantom town' in Lancashire that appears on Google Maps and online directories but doesn't actually exist, has puzzled internet experts. The town appears on Google Maps in the middle of fields close to the M58 motorway, just south of Ormskirk.

Its 'presence' means that online businesses that use data from the software have detected it and automatically treated it as a real town in the L39 postcode area. An internet search for the town now brings up a series of home, job and dating listings for people and places "in Argleton", as well as websites which help people find its nearest chiropractor and even plan jogging or hiking routes through it. The businesses, people and services listed are real, but are actually based elsewhere in the same postcode area.

Google and the company that supplies its mapping data are unable to explain the presence of the phantom town and are investigating. Tantalisingly, “Argle” echoes the word “Google”, while the phantom town’s name is also an anagram of “Not Real G”, and “Not Large”.

One theory is that Argleton could have been deliberately added, as a trap to catch companies that violate the map's copyright. So-called "trap streets" are often inserted by cartographers but are, as their name suggests, usually far more minor and indiscreet that bogus towns.

Roy Bayfield, head of corporate marketing at what would be Argleton's closest university, Edge Hill, in Ormskirk, was so intrigued by the mystery that he walked to the where the internet indicated was the centre of Argleton to check that there was definitely nothing there.

"A colleague of mine spotted the anomaly on Google Maps, and I thought 'I've got to go there'," he said.

"I started to weave this amazing fantasy about the place, an alternative universe, a Narnia-like world. I was really fascinated by the appearance of a non-existent place that the internet had the power to make real and give a semi-existence." When Mr Bayfield reached Argleton – which appears on Google Maps between Aughton and Aughton Park – he found just acres of green, empty fields.

Look away now if you are having your food: here is a list of some of the strangest food specialities from around the world.

Fried tarantulas – Cambodia

An arachnophobe's worst nightmare comes fried and crunchy in Cambodia. In Phnom Penh markets and in the town of Skuon, locals deep fry spiders for locals and adventurous tourists alike. Buy one of these crispy snacks from a wandering hawker and you may even get to play with a live tarantula before tucking into one of his hairy brothers. The abdomen is only for the truly brave and is said to taste like "licking damp cobwebs."

Cuy (guinea pig) – Peru

They may look cute in the classroom but a guinea pig on your plate looks less adorable. Peruvian families keep guinea pigs as they are a good source of protein for villagers living up in the Andes. Cuy, as they are called, are generally roasted before they are served with all limbs and the head attached. There is not a great deal of meat on them and the skin can be rather rubbery but otherwise they taste similar to rabbit.

Casu marzu – Sardinia

This is a Sardinian speciality that comes with a health warning. Most food that's crawling with maggots finds its way into the bin but the decomposition of this "rotten cheese" is positively encouraged. Pecorino Sardo is set aside so that cheese flies can lay eggs inside the rind which then hatch into crawling maggots. These feed on the cheese, aiding fermentation and producing a pungent smell. Officially banned in the EU, the maggots are eaten live with the cheese, assuming they haven't jumped away first – some can jump up to 15cm.

Hakarl (fermented shark) – Iceland

An Icelandic speciality, Hakarl is certainly an acquired taste. It is traditionally made by gutting a basking shark, placing it in a hole, covering the carcase with gravel and stones and then leaving it to ferment for up to three months. The shark is then cut into chunks which are hung for several months more. The smell is repugnant, though the taste is said to be reasonable.

Civet excrement coffee – Asia

Considered a delicacy in parts of Asia, these coffee beans are roasted after passing through the digestive system of a civet. Farmers on coffee plantations allow the weasel-like creatures to eat their crop in order to collect their bean-filled droppings for a steamy and surprisingly chocolatey beverage. While it has yet to make the menu at Starbucks, the beans can be bought in shops in London, including Selfridges

Fugu – Japan
Certainly not as repugnant as some of the other dishes on our menu, fugu – or puffer fish – has nevertheless become a notorious delicacy thanks to the fact that eating it can be fatal unless it is properly prepared. The fish's liver, ovaries and skin contains large amounts of the poison tetrodotoxin and there is no known antidote

Balut – Philippines
Sometimes described as "eggs with legs", Balut is an utterly gruesome – by some Western standards – delicacy from the Philippines. A common, everyday food, it is a fertilised duck or chicken egg containing a nearly-developed embryo – including feathers, feet, et al – that is boiled and eaten straight out of the shell. If you're not too squeamish, there are plenty of videos on YouTube.

Levels of privacy

People with only a casual concern for Internet privacy need not achieve total anonymity. Internet users may achieve an adequate level of privacy through controlled disclosure of personal information. The revelation of IP addresses, non-personally-identifiable profiling, and similar information might become acceptable trade-offs for the convenience that users could otherwise lose using the workarounds needed to suppress such details rigorously. On the other hand, some people desire much stronger privacy. In that case, they may try to achieve Internet anonymity to ensure privacy — use of the Internet without giving any third parties the ability to link the Internet activities to personally-identifiable information of the Internet user.

Those concerned about Internet privacy often cite a number of privacy risks — events that can compromise privacy — which may be encountered through Internet use. These methods of compromise can range from the gathering of statistics on users, to more malicious acts such as the spreading of spyware and various forms of bug exploitation.

Privacy measures are provided on several social networking sites to try to provide their users with protection for their personal information. On Facebook for example privacy settings are available for all registered users. The settings available on Facebook include the ability to block certain individuals from seeing your profile, the ability to choose your "friends," and the ability to limit who has access to your pictures and videos. Cookies are tools which are sometimes used for user-tracking, a common concern in the field of privacy. As a result, some types of cookies are classified as a tracking cookie. Although HTML-writers most commonly use cookies for legitimate purposes, cases of abuse can and do occur.

An HTTP cookie consists of a piece of information stored on a user's computer to add statefulness to web-browsing. Systems do not generally make the user explicitly aware of the storing of a cookie. (Although some users object to that, it does not properly relate to Internet privacy. It does however have implications for computer privacy, and specifically for computer forensics).

The original developers of cookies intended that only the website that originally distributed cookies to users could retrieve them, therefore returning only data already possessed by the website. However, in practice programmers can circumvent this restriction. Possible consequences include:

the placing of a personally-identifiable tag in a browser to facilitate web profiling (see below), or,

use of cross-site scripting or other techniques to steal information from a user's cookies.

Some users choose to disable cookies in their web browsers - as of 2000 a Pew survey estimated the proportion of users at 4%[2]. Such an action eliminates the potential privacy risks, but may severely limit or prevent the functionality of many websites. All significant web browsers have this disabling ability built-in, with no external program required. As an alternative, users may frequently delete any stored cookies. Some browsers (such as Mozilla Firefox and Opera) offer the option to clear cookies automatically whenever the user closes the browser. A third option involves allowing cookies in general, but preventing their abuse. There are also a host of wrapper applications that will redirect cookies and cache data to some other location.

The process of profiling (also known as "tracking") assembles and analyzes several events, each attributable to a single originating entity, in order to gain information (especially patterns of activity) relating to the originating entity. Some organizations engage in the profiling of people's web browsing, collecting the URLs of sites visited. The resulting profiles can potentially link with information that personally identifies the individual who did the browsing.

Some web-oriented marketing-research organizations may use this practice legitimately, for example: in order to construct profiles of 'typical Internet users'. Such profiles, which describe average trends of large groups of Internet users rather than of actual individuals, can then prove useful for market analysis. Although the aggregate data does not constitute a privacy violation, some people believe that the initial profiling does.

Profiling becomes a more contentious privacy issue when data-matching associates the profile of an individual with personally-identifiable information of the individual.

Governments and organizations may set up honeypot websites - featuring controversial topics - with the purpose of attracting and tracking unwary people. This constitutes a potential danger for individuals.

Today many people have digital cameras and post the resulting photos online. The people depicted in these photos might not want to have them appear on the Internet.

Some organizations attempt to respond to this privacy-related concern. For example, the 2005 Wikimania conference required that photographers have the prior permission of the people in their pictures. Some people wore a 'no photos' tag to indicate they would prefer not to have their photo taken.

Consumers obtain Internet access through an Internet Service Provider (ISP). All Internet data to and from the consumer must pass through the consumer's ISP. Given this, any ISP has the capability to observe everything about the consumer's (unencrypted) Internet.

However, ISPs are usually prevented from participating in such activities due to legal, ethical, business, or technical issues.

Despite these legal and ethical issues, some ISPs, such as British Telecom (BT), are planning to use deep packet inspection technology provided by companies such as Phorm in order to examine the contents of the pages which people visit. By doing so, they can build up a profile of a person's web surfing habits, which can then be sold on to advertisers in order to provide targeted advertising. BT's attempt at doing this will be marketed under the name 'Webwise'.

Normally ISPs do collect at least some information about the consumers using their services. From a privacy standpoint, ISPs would ideally collect only as much information as they require in order to provide Internet connectivity (IP address, billing information if applicable, etc).

What information an ISP collects, what it does with that information, and whether it informs its consumers, pose significant privacy issues. Beyond the usage of collected information typical of third parties, ISPs sometimes state that they will make their information available to government authorities upon request. In the US and other countries, such a request does not necessarily require a warrant.

An ISP cannot know the contents of properly-encrypted data passing between its consumers and the Internet. For encrypting web traffic, https has become the most popular and best-supported standard. Note however, that even if users encrypt the data, the ISP still knows the IP addresses of the sender and of the recipient. (However, see the IP addresses section for workarounds.)

General concerns regarding internet user privacy have become enough of a concern for a UN agency to issue a report on the dangers of identity fraud[3].

Many programs and operating systems are set up to perform data logging of usage. This may include recording times when the computer is in use, or which web sites are visited. If a third party has sufficient access to the computer, legitimately or not, the user's privacy may be compromised. This could be avoided by disabling logging, or by clearing logs regularly.

Use by government agencies of an array of technologies designed to track and gather Internet users' information are the topic of much debate between privacy advocates, civil libertarians and those who believe such measures are necessary for law enforcement to keep pace with rapidly changing communications technology.

Specific examples

Following a decision by the European Union’s council of ministers in Brussels, in January, 2009, the UK's Home Office adopted a plan to allow police to access the contents of individuals' computers without a warrant. The process, called "remote searching", allows one party, at a remote location, to examine another's hard drive and Internet traffic, including email, browsing history and websites visited. Police across the EU are now permitted to request that the British police conduct a remote search on their behalf. The search can be granted, and the material gleaned turned over and used as evidence, on the basis of a senior officer believing it necessary to prevent a serious crime. Opposition MPs and civil libertarians are concerned about this move toward widening surveillance and its possible impact on personal privacy. Says Shami Chakrabarti, director of the human rights group Liberty, “The public will want this to be controlled by new legislation and judicial authorisation. Without those safeguards it’s a devastating blow to any notion of personal privacy.”[4]

The FBI's Magic Lantern software program was the topic of much debate when it was publicized in November, 2001. Magic Lantern is a Trojan Horse program that logs users' keystrokes, rendering encryption useless. [5]

[edit]Jason Fortuny and Craigslist

In early September 2006, Jason Fortuny, a Seattle-area freelance graphic designer and network administrator, posed as a woman and posted an ad to Craigslist Seattle seeking a casual sexual encounter with men in that area. On September 4, he posted to the wiki website Encyclopædia Dramatica all 178 of the responses, complete with photographs and personal contact details, describing this as the Craigslist Experiment and encouraging others to further identify the respondents.[6]

Although some online exposures of personal information have been seen as justified for exposing malfeasance, many commentators on the Fortuny case saw no such justification here. "The men who replied to Fortuny's posting did not appear to be doing anything illegal, so the outing has no social value other than to prove that someone could ruin lives online," said law professor Jonathan Zittrain[7] , while Wired writer Ryan Singel described Fortuny as "sociopathic".[8]

The Electronic Frontier Foundation indicated that it thought Fortuny might be liable under Washington state law, and that this would depend on whether the information he disclosed was of legitimate public concern. Kurt Opsahl, the EFF's staff attorney, said "As far as I know, they (the respondents) are not public figures, so it would be challenging to show that this was something of public concern."[7]

According to Fortuny, two people lost their jobs as a result of his Craigslist Experiment and another "has filed an invasion-of-privacy lawsuit against Fortuny in an Illinois court." [9]

Fortuny did not enter an appearance in the Illinois suit, secure counsel, or answer the complaint after an early amendment. Mr. Fortuny had filed a motion to dismiss, but he filed it with the Circuit Court of Cook County, Illinois, and he did not file proof that he had served the plaintiff.[10]. As a result, the court entered a default judgment against Mr. Fortuny and ordered a damages hearing for January 7, 2009.[11] After failing to show up at multiple hearings on damages,[12][13] Fortuny was ordered to pay $74,252.56 for violation of the Copyright Act, compensation for Public Disclosure of Private Facts, Intrusion Upon Seclusion, attorneys fees and costs.[14]

[edit]Search engine data and law enforcement

Data from major Internet companies, including Yahoo! and MSN (Microsoft), have already been subpoenaed by the United States[15] and China[16]. AOL even provided a chunk of its own search data online[17], allowing reporters to track the online behaviour of private individuals[18].

In 2006, a wireless hacker pled guilty when his Google searches were used as evidence against him. The defendant ran a Google search over the network using the following search terms: "how to broadcast interference over wifi 2.4 GHZ," "interference over wifi 2.4 Ghz," "wireless networks 2.4 interference," and "make device interfere wireless network." While court papers did not describe how the FBI obtained his searches (e.g. through a seized hard-drive or directly from the search-engine), Google has indicated that it can provide search terms to law enforcement if given an Internet address or Web cookie. [19]

In the United States many cases discuss whether a private employee (i.e., not a government employee) who stores incriminating evidence in workplace computers is protected by the Fourth Amendment's reasonable expectation of privacy standard in a criminal proceeding.

Most case law holds that employees do not have a reasonable expectation of privacy when it comes to their work related electronic communications. See, e.g. US v. Simons, 206 F.3d 392, 398 (4th Cir., Feb. 28, 2000).

However, one federal court held that employees can assert that the attorney-client privilege with respect to certain communications on company laptops. See Curto v. Medical World Comm., No. 03CV6327, 2006 U.S. Dist. LEXIS 29387 (E.D.N.Y. May 15, 2006).

Another recent federal case discussed this topic. On January 30, 2007, the Ninth Circuit court in US v. Ziegler, reversed its earlier August 2006 decision upon a petition for rehearing. In contrast to the earlier decision, the Court acknowledged that an employee has a right to privacy in his workplace computer. However, the Court also found that an employer can consent to any illegal searches and seizures. See US v. Ziegler, ___F.3d 1077 (9th Cir. Jan. 30, 2007, No. 05-30177). [1] Cf. US v. Ziegler, 456 F.3d 1138 (9th Cir. 2006).

In Ziegler, an employee had accessed child pornography websites from his workplace. His employer noticed his activities, made copies of the hard drive, and gave the FBI the employee's computer. At his criminal trial, Ziegler filed a motion to suppress the evidence because he argued that the government violated his Fourth Amendment rights.

The Ninth Circuit allowed the lower court to admit the child pornography as evidence. After reviewing relevant Supreme Court opinions on a reasonable expectation of privacy, the Court acknowledged that Ziegler had a reasonable expectation of privacy at his office and on his computer. That Court also found that his employer could consent to a government search of the computer and that, therefore, the search did not violate Ziegler's Fourth Amendment rights.

Apple Releases the New iPhone

With under-the-hood hardware changes, a new camera that shoots video and more storage room for a growing number of apps, Apple's new iPhone 3G S is a faster, more flexible, more capable mobile device.

When Apple Inc.'s new iPhone 3G S -- the "S" stands for speed -- officially went on sale this morning, I made sure I was one of those standing in line at an AT&T store so I snap one up as soon as the doors opened. Unlike past years, the number of people waiting at stores around the U.S. to get the new iPhone was smaller, perhaps because the latest model is evolutionary -- not revolutionary -- compared to the original iPhone or the 3G model that debuted last summer. (More likely, it's because buyers could pre-order it and either pick it up at the store or have it delivered directly to their home.)

AT&T divided the 20 or so people in line into walk-in buyers and those who pre-ordered. I was a walk-in, so I had to wait while those who pre-ordered the phone by last Friday got their phones first. Time to wait for the 32GB model I wanted: about 55 minutes after the store opened. Price out the door: $299 (I've been using the first-generation EDGE-based model, so I qualified for AT&T's upgrade pricing.)

AT&T activated my phone at the store, then I dashed home to sync up my personal data and apps using iTunes. The sync took about an hour, which is not surprising, given that the restore copied over 16GB of apps, music, movies and TV shows.

Physically, the iPhone 3G S looks and feels no different than the last generation model. The only tell-tale sign is the small text that reads "32GB" on the back of the phone, storage capacity that wasn't available to previous generation phones. In one fell swoop, I've doubled the space I have for more apps and data.

The new 3G S comes in a choice of colors, as long as your choice is white or black. I stayed with black. And I quickly noticed that the new coating on the screen actually works. The iPhone is still a fingerprint magnet, but the screen wipes clean very easily.

Given that the form factor hasn't changed, anyone with an older 3G model shouldn't have any problems using previously bought accessories like external cases. What new 3G S owners will notice are the under-the-hood changes Apple has made. Though it isn't talking about the hardware details, other sites have reported that the 3G S has a new Arm processor and more RAM, meaning -- just like a newer, faster computer -- it should run faster and more smoothly.

It does. Navigating around my apps, I found the 3G S to be more responsive and smooth when launching programs and surfing the Web.

The original iPhone, released at the end of June 2007, shipped with hardware that at the time offered a pretty significant jump for mobile technology. Two years in technology terms is like two decades in human years, more than enough time for products that have lived normal, active lives to be sent to retirement homes in Florida. Even so, the release earlier this week of iPhone OS 3.0 freshened even the first-generation iPhone I had been using.

On the 3G S, the updated OS works well with some of the phone's new features, especially the higher-resolution camera -- three megapixels -- that can for the first time take video and has auto-focus. The Camera application produces noticeably sharper, more color-balanced pictures. Touching any part of the screen automatically focuses on the area you've tapped. It easily outshines the camera used on earlier models.

Better yet, the new camera can record VGA-quality footage in either landscape or portrait modes. VGA-quality video -- 640 pixels by 480 pixels -- while not great for shooting feature films, is plenty fine for Web video and maybe even iMovie projects. Plus you can now upload movies shot on the phone from in much the same way photos can be uploaded on earlier models. One note: Once you start shooting video, you can't change the camera's focus.

The 3G S also has a compass, which will make it hard for you ever to get lost as long as you have your 3G S with you. The virtual compass follows your movements in real-time, displaying a readout of your position in terms of which direction you're facing. The compass also display the coordinates received from the GPS signal -- and a single touch of the compass' location button automatically displays that location in Maps.

I haven't had time yet to fully put the iPhone 3G S through its paces, but will be doing so over the next few days for a full review Computerworld will post next week.

But it's clear that Apple's latest iPhone should be another winner. With the addition of a bumped-up processor, additional memory, the new camera and more storage room , this iPhone is simply a faster, more capable computer. It's the equivalent of moving from an old PC or Mac to newer and better hardware. If last year's iPhone 3G can be summed up as: faster data connection/more accurate location support, then this iPhone can be summed up so as upgraded hardware and a noticeably improved user experience.

All in all, I'm quite taken.

"Software" is sometimes used in a broader context to mean anything which is not hardware but which is used with hardware, such as film, tapes and records.
